Terms of Service

1. Agreement

These Terms govern your access to and use of the Embellify studio and API (the “Service”). By creating an account or calling the API, you agree to these Terms. If you are using the Service on behalf of an organisation, you represent that you are authorised to bind it.

2. Credits and billing

The Service is billed by credits. Credit packs are purchased one-off and do not expire. One generation consumes at least one credit; failed generations are refunded automatically to your balance. Purchased credits are non-transferable and, except as required by law, non-refundable for cash.

3. Your content

You retain all rights to the images you upload and to the outputs you generate. You are responsible for ensuring you hold the rights to any product photo you submit, and that your use of the outputs complies with applicable law and any third-party rights.

4. Acceptable use

You agree not to use the Service to:

• infringe intellectual property or publicity rights;
• generate misleading imagery of products you do not own or represent;
• create unlawful, deceptive, or harmful content;
• attempt to disrupt, reverse-engineer, or circumvent rate limits of the Service.

5. Availability

We aim for high availability but do not warrant uninterrupted service. We may modify, suspend, or discontinue features with reasonable notice where practicable.

6. Liability

To the maximum extent permitted by law, the Service is provided “as is”, and our aggregate liability arising from the Service is limited to the amount you paid for credits in the three months preceding the claim.
